| | | citizens arrest question What is the name of your state? new mexico.
The first question is if for some reason the police were to come into my house legally, and find drugs, is everyone living at the house responsible. I understand that anyone in the house at the time, that has access to the drugs would be going to jail. I m asking about serious drugs, like cystal meth.
This leads to my main question about doing a citizens arrest. If I have a resonable befief that my roommate is using or has posstion of drugs, can I citizens arrest him and call 911. Can anyone tell me the proper way to do this. If I were to call the police and say I can see my roomate smoking crack, come and arrest him, they would laugh. This is a rough part of the country, the police already told me, their job is to clean up after the crime. thank you |

| | | That would work. Or, you could go to the police and bring them and show them where the drugs are. (They can't search for them or use you as their agent, you have to do it on your own.)
Go to the police station and ask them how they would like to handle it.

If I were to call the police and say I can see my roomate smoking crack, come and arrest him, they would laugh. | The point of a citizens arrest is to detain somebody for the police. If the police don't care about the suspect, then it's meaningless. Quote:

Actually, the police have the job of enforcing the law. It's not about whether or not they "care". If someone is doing something illegal, the police have the duty to uphold the law when they are notified of the illegal activity. If the police are only going to do their job whenever they "care" enough to do it, they aren't much use for anything. |
