My son was convicted of a crime he didn't commit. Can I sue the person who falsely accused him, because she knowingly lied?
My response:
Was your son's conviction overturned on appeal?
If your son still, as of this day, stands convicted of the crime, then no you can't sue for two reasons:
1. You have no legal standing to sue anyone. You were not the "object" of the allegations, the crime, or the subsequent conviction;
2. Your son has the "standing" to sue. But before he can do that, he needs his conviction overturned and the reversal of his conviction must be based upon proof that she perjured her testimony.
Presuming he still stands convicted, then in the eyes of the law, he's guilty of the crime(s).
