Court Date Done for Public IntoxicationWhat is the name of your state?California Hello Carl Thanks a lot for your responses. What happens to me in court is that I plead no contest and judge sentence me 1 day in jail and as I have already served that he gave me credit of 1 day and thats it. He said no probation no fine. You are good to go. Now Carl I am having one more worry which I think you can help me out. I am an immigrant. This worry is regarding deportation. 1 day before my court date when I called them about my charge they said "Disorderly COnduct under influence of drugs" but the panel code was 647(f). As you advised me last time too that only Panel Code is something impotant not what they call it. But even when judge read my charges he said 647(f) Public Intoxication. Even on my ticket it says Public Intoxication 647(f). But there was a document in the court room on which list of all defendants were there for that day. That document says 647(f) Disorderly conduct under influence of drugs. Now my worry starts as I have read somewhere on internet that any alien who violates any law of controlled substance can be deportable. I never touched any kind of drugs in my whole life even on that day I was having some shots of whiskey and thats it. They never found anything from me. They never took my blood sample. how they can say that it is Drugs. or may be I am wrong and they say this kind of charge generally as Drugs. Now I am going to INS this week for my immigration purposes and I will tell them about this incident of they ask it. I want to be honest with them but only this drug word is scaring me a lot. Please advise Carl or any other attorney. I really need your help sir. Regards |

| They could have said "PC 647(f) under the influence of the tides" and it would still be the same charge. You were convicted of public intoxication per PC 647(f). What some clerk typist labeled the charge as on his/her boilerplate is not relevant. I can't imagine that a PC 647(f) conviction would effect your immigration status. If it had been an issue, most likely an immigration hold would have been placed upon you already when you were in custody or at court. Relax. - Carl
