Criminal Threat Case


What is the name of your state? Irma, California


well it all started on july and here are the details.



The night of the incident I was parked outside on the
street about 7 houses to the left from
my house, me and my boyfriend were playing a wrestling
video game on my video game system in my car. About 1
hour later this small older lady came to my left my side of the car which ids the drivers seat and processed to yell at me and cursing at me “its been 1
HOUR 1 FU*** HOUR AND YOU fu** Mexicans wont stop
your ****ing noise!” I then stood silent I did not
respond to her as I have respect for my elders. But
got a bit sensitive and started crying. Then my
boyfriend told her not to make such a big fu*** deal
about it.
Then after she walked to her house in that moment I
thought she would just call the police (I say if we
were really the problem she should had).we had never
been pulled over by the police in that particular spot
so what they state that we have been there for a long
time and they called them is irrelevant. If we would
have been warned before we would had never came back
there anymore even thought it’s a public street.

but instead she proceeded to get her husband in this
case Mr. Brown involved, he then surprised us by
hitting the right window of the car with a police like
flash light he was yelling “who do you think you are
you punk” “get the f*** out and go back to Mexico”

Then my boyfriend responded “you think cause you’re a
rich person you can insult me like that” then he
got mad and told him “you don’t know who your dealing
with”

Mr. Brown then said “I am going to go get my gun and
shoot you!” then I got really scared and just told my
boyfriend we should leave I proceeded to drive to my
house I parked the car in the drive way ,I then called
911 my mom proceeded to give me the phone to do so.
Then I stayed outside to wait for the police I stood
behind my car then Mr. Brown proceeded to drive up to
my driveway almost hitting us both me and my boyfriend
the car was about 14 inches away from us. I started to
get an attack after that and I overheard Mr. Brown say
“SEE WHAT YOU MADE ME DO?” then my boyfriend told him
to get way he was standing in private property (My
property).

After he heard the sirens he got back into
he’s car and was reversing on the street presumably to
avoid being seen by the police. But then the police
came he preceded north toward my house again. My
mother Taylor Kerr was a witness of this and saw the
whole car inccident from her house window.

The police then took the report and asked us for
information.
I believe that if they were really threatened they
would not have proceeded to follow the alleged
suspect. Instead of following them with a loaded gun
they would have called the police and let them handle
it themselves.

But I believe Mrs. Brown is making this
up to get revenge on her husband for the arrest on
him. I saw Mr. Brown roaming our house on several
occasions to the point I had to stay with my father
for a while because she is afraid for her and her
family’s safety a family of 8 including 6 minors,
because of what happened. I am very upset because I am
also afraid this person will get revenge on me and my
loved ones. I would like him not to get near my house
and make my family feel scared for their safety.


another thing is he had Preliminary on a week ago and the judge did not drop the case since my BF has past probation for throwing an object at a vehecle and was charged with assault with a deadly weapon and got 5 years probation and 200hrs community service and time served 1 month in jail,. well the judge said " the chances you gettin out today are very slim" " these cases look too similar". well he does not know the facts of the prior case he just read what he had.
he just reduced bail from 75,000 to 25,000.
then he has the 2nd phase this friday, dont know if he will get out or not. this is all a lie from the bad guys wife.

help me with advice I am very upset about this i need to hear you guys.

I'd say it is time to hire an attorney.

You are parked 7 houses down from your own house playing video games in your car for over an hour? Why not just park in front of your own home and play?

What's your point? It's a mostly free country she can park anywhere she wants if it's legal to do so.

Forensic Analysis


The forensic analysis of this post leads me to believe that this thread has been authored along the lines of recent threads on 'stalkers' with some variation in the storyline. ... Please prove me wrong... OP, please post your questions in the most specific, convincing, and lucid way possible.

I believe it is legal to park anywhere. its her street too. and I believe that what she wanted was ADVICE hence the name of this site. she wants a possible answer to what might happen. and I think this was a false accusation by the wife from what I read. I think he will get out and continue his previous probation. you should also counter sue for compensation for him being falsely in jail. and dont worry a word against evidence and the other partys arrest will go in your favor.

It is very difficult to successfully sue someone for allegedly making a false report to the police. Proving something did NOT happen is harder that proving something DID happen. And unless the OP is swimming in a few thousand dollars to pay an attorney up front, I doubt that a civil suit is going to be realistic.

well he can sue for the pain and suffering in the jail. AND EXACLY the other guy had the loaded gun and got arrested. then way later the wife of the guy who went to jail for this makes this claim. I would sue if i was him theres laws about Lying in court about something "criminal threat" he can prosecute.

He's out of Jail this Friday my dear.

this looks like a "my husband went to jail now you will pay" kind of thing and I know the pasadena court it'll e hard for the other party to prove it since the only witness is the guy that got arrested WITH A LOADED GUN. following you to your house.

Anyone can sue anyone for anything ... winning is a darn sight more difficult. And with this situation (muddy as it may be - and with two sides and two versions of events) it will likely be impossible to completely discern the truth.

But, there are always attorneys who will be willing to take $$$.
