What is the name of your state (only U.S. law)? CA

can a judge order a test to determine whether someone has had sex?

What type of test will it be??DNA? Was it a sexual assault?

It can be difficult to impossible to determine if a person has had sex. What is the situtation?

OP did not state sex of person. Nor did OP state that this is a case of determining if a person has had sex with a particular individual.

What test exists that can tell if a man has had sex?

the situation


An individual attempting to annul a marriage based on non-consumation. One party (female) claims they have, the other claims they haven't (male) and the female is a virgin (however, hymen not intact). Can a judge order a test to determine consumation?

Get a divorce.

It's easier, cheaper, and quicker.

(There's no such test.)

Can't see this proving anything anyway. Even if there was a reliable scientific method that could prove a person has had sex, how would that prove who their sex partner was?

This is also 2008, marrying a virgin is rare......

the question isn't about how to test, the question is can a judge order an individual be tested?
is there any legal precedence?
