dejWhat is the name of your state? CA. I am currently on deferred entry of judgement, which I aquired 12/04.. I was placed on 3 yrs. probation and comleted drug school and paid off half of my $1500.00 fine, What I need to know is, can I modify and just do the time in county jail to finish off fine, end probation, and expunge record? I cannot afford to pay the rest of the fine, pay my bills, and support my daughter on a waitress salary. |

| That's not something anybody here can answer. You need to bring that up with your probation officer or the judge. |

| Don't make such a crazy decision. DEJ means your entire case will be dismissed. Some Judges will order probation to do a financial review to see if your probation costs can be reduced; a few renegade Judges will dismiss the charge with probation fees due. However, the probation costs are well worth it - the drug charges are dismissed - the case is terminated; no sentence is imposed. Pay them the money. Don't fool around with the charge - just get it dismissed. Some hard-head Judges will terminate DEJ and impose sentencing, because you didn't pay the costs as you promised when you agreed to participate in DEJ. You were given a great opportunity to clear your record - don't blow it. BTW, they are not fines - they are probably the probation costs for DEJ. You can't do community service or jail time in lieu of payment. Your DEJ case should have been dismissed after 18 months and completion of program and fees. The only thing holding up a dismissal is $750. payment on your part ... hmmmm do I want a drug record and $750 or do I want $0 and a clean record ??? I'd be busy borrowing money to get that case dismissed. |
