What is the name of your state? California however this situation happened in Florida.

This is a few questions.

1. I was told when I went to pay a traffic violation that I didn't appear in court and that a warrant had been issued for my arrest, however I never requested to appear in court and the citation wasn't mandatory that I appear. What do I do?

2. I did a payday loan with a check cashing company. I postdated a check and received the loan. However, my account was closed before the check was cashed. It was a mess. Needless to say it never was cleared up, I've been threatoned numerous times buy what I think is a collection agency that calls themselves fraud detectives. I was called 5 times on day and was screamed at. Moreover just yesterday they called my former residence and spoke with a family member, they told him that I had a bench warrant issued for my arrest for a bad check. Is this for real, now what do I do. By the way, this perticular company has a past history of threatoning people.

3. I'm working on trying to get this all cleared up, however I'm so confused and frustrated. If i get pulled over, what happens. Do i get arrested and taken back to Florida? I was told one by a friend that's in law enforcement that since it's not a major crime I probably won't be extradited. Granted that's not a excuse to no clear things up, because I am. Is that true though? How does extradition work?

You guys are really awesome and any advice I can get will help me out tremendously.

re-read the summons that the officer gave you and that you signed. somewhere on the 'ticket' is the statment that you promise to appear at the date and time on the ticket. If you pay the ticket BEFORE this date then you have effectively pled guilty and you pay the fine.

It's called fraud for a reason. And yes, you did commit the crime of fraud. As to whether or not this is a civil matter or the company actually filed fraud charges against you you'll have to check that with the court in the county where you performed this deed.

If i get pulled over, what happens. Do i get arrested and taken back to Florida? I was told one by a friend that's in law enforcement that since it's not a major crime I probably won't be extradited.
This 'friend' is maybe right or wrong. But extradition is not your biggest problem. IF you in fact do have a warrant for your arrest in Florida, the next time you try to renew your driver's license go to the shoe store instead and buy a good pair of walking shoes. If a warrant exists in any state and it is found, you will not be able to renew your license.

The first thing you need to do is determine IF a warrant exists, then you need to pay the company back what you effectively stole from them, and don't be surprised if there are legal fees attached, it's perfectly legal for them to do so.

And dont expect it to be a lousy $50-100.....try like $500-1000 or more...to catch your azz and to make you pay up.

So say I get stopped by the police, what happens? Do I go to jail, get returned to Fl? I've no clue about the legal process, and you've been a great help so far.

Or do i get tried here?

My suggestion is to have a BIG CHUNK of CASH available, so you can bail yourself out of this mess.

Police stations at least here in NYC will let you use your ATM or credit card to pay fines or bail money. so yours should be near a zero balance. Just in case.......
