Dismissed Case


What is the name of your state (only U.S. law)? California

if a criminal case against you is dismissed can you sue for the money owed to the bailbondsman and/or the emotional and financial hardship on you and your family?

A: Yes, anyone may sue anybody else for anything at any time, anywhere.

A: No.

Who do you think you would sue?

If someone made the whole thing up, you might have cause for a civil action, but absent that this would be a losing action for you.

If lawsuits were allowed against witnesses and the state for every case that was either dismissed or not pursued by the DA (even after an arrest), the system would collapse in a week. The key is dealing with intentional malfeasance.
