Hello,

We live in an apartment building and over the course of a year we have had to call the cops on one particular neighbor about 4-5 times. They are outside (about 20 feet from our windows) being loud enough to wake us up between 12am-4am in the morning. They have woke us up so many times that we are at the breaking point. Most of the time i call the cops, they come over and things quiet down. Keep in mind generally i try to get them to quiet down before i call. Last night at about 12am they walked by our window and made a smart comment which we ignored, something to the effect of "we love you hope you are sleeping good". At about 2am they woke us up once again and i asked them to be quiet. They said what are you going to do call the cops... what a surprise.

I came in the house and called the cops. About 20 minutes later a cop arrives and i went out to talk with him. He said i was wasting his time and i needed to go back inside as this was nothing to worry about. He has been here a few times himeself.

One occasion was a party, i also spoke with him on the phone about thier dog not being on a leash and on 2 occasions the dog tried to bite my step daughter and myself.

A lot has gone on and i do not appreciate the way the cop was talking to me last night.

Is there really nothing the cops can do in this situation? My landlord said there is nothing he can do that i should call the cops, the cops say there is nothing they can do and to go back to bed.

All i know is that if i cannot get sleep, i am going to get a hotel room and bill the landlord for every night spent there.

I would also like to add that it is not just my girlfriend and myself living here. We have a 9 year old and 13 month old. If it were just us we wouldnt mind, hell we'd probably join in. However the responsibilities of parenting kick in and you have to protect your babies even from being woke up in the middle of the night.

First, the state police are not going to respond to a town where the local cops have jurisdiction.

Second, if the local officer is not doing anything and you believe he should, you have the freedom to speak to his supervisors. I would think something COULD be done, but not being from VT I don't know what the limitations are in these situations. There is no law anywhere that will require the police to act in this situation.

You can also look into how to go about a civil suit against your neighbor in small claims or superior court for the continuing harassment.

If the police are choosing not to act, then this is a political issue that you might need to address at the town/city level.

I have put in a call to the chief of police and i am awaiting to hear back from them. I think on Monday i will attend the selectmens town meeting.

I called the state police because that is the only # available in the book, the local town cops work out of the local state barracks in castleton however no one is ever there after 11pm so you have to call Rutland's barracks for them to dispatch the town cops.
