DNA testing. Assault weapon law repealed?


What is the name of your state? New York

Do you have any information on the new CONDIS program Senate Bill 1000 that make people submit DNA violating their Fourth Amendment rights. How has to do it? I thought it was violent felons? Convicted of Class B felonies. I had a non violent 3rd degree attempted possession of a weapon charge, a Class E felony, and they want my DNA. What do I do? Is this legal, and who are the people who must sumit to this DNA testing? Also Sept. 13th 2004 the assault weapon ban may end. What happens to people who were convicted of having an assault weapon? Why do they still sell them in stores if illegal? Can anyone appeal a conviction of the assault weapon charge if it no longer exists? Just like prohibition in the 30s. If the law is no more, why should we still suffer from probation or jail?

The only questionI can answer is the continued sale of "Assault Weapons" ( a misnomer coined by the liberal media, by the way).

The "Assault Weapons Ban" is a federal law prohibiting the manufacture or sale of newly manufactured semi-automatic rifles with certain (mainly cosmetic) features such as a flash-suppressor, boynet lug, etc, as well as magazines capable of holding more than 10 rounds. This is the law you are refering to when mentioning the September 13th sunset date.

The reason you still see similar weapons sold are because of one of two reasons:

Number 1 - They were manufactured prior to the effective date of the law, and are therefore still lawful to sell and possess.

Number 2 - They conform to the law in that they do not possess the characteristics that were outlawed.

However, it seems like you were convicted under a NY State law, not the Federal statute. I'm not familiar with the law in NY, although I would surmise that it will remain beyond the sunset date of the Federal law regardless of the outcome of any federal legislation. NY is notoriously anti-gun.

Since you were convicted under a law on the books in NY that will likely remain, the September 13th sunset of the ban should have no affect on that.
