If you are arrested and in jail for 90 days and have not been indicted during that time will you automatically be released on day 91?

If so and you are indicted shortly after are you detained again till your trial? Or do you remain out on your PR until sentenced?

The law states that a Judge shall release a Defendant on a PR bond if not indicted after the 90th day. If on day 91 someone catches it, then the judge would sign the order. If nobody notices it, maybe they'll notice it on day 92, and so on. There are rare circumstances where you'd really need more than 90 days to get ready to present to Grand Jury so usually when the deadline comes and goes its because the case fell through the cracks. So really the Defendant's attorney should bring it to the courts attention after the 90th day.

Once released on the PR bond that is the bond for the case. A subsequent indictment doesn't revoke that bond but it is possible for the State to file a motion for the bond to be increased. It would then be set for a hearing.
