drunk in public


arrested in California charged with 69, 148 (a) (1), 647 (f). I'm wondering what these charges mean. I'm really worried if any of these are felonies.

Basically what happened was. I was drunk, went to safeway to get pizza (in a pair of underwear to be funny). On my way out the door a cop told me to get up against the wall. I was so drunk i didn't know exactly what was going on and continued to walk. the cop then grabbed me swung me around and bashed my face into the concrete. this is when i started running my mouth don't remember what was said. After this i vaguely remember being taken to the hospital on a stretcher got 5 stitches in my eyebrow. A completely sober girl was with me that witnessed to entire event. She is the only reason i can tell this much of the story. After i was taken away the cop told this girl he felt horrible about what he had done to me.

Any advice is appreciated I know how stupid i am so we can skip that, thanks.

PC 148(a) and PC 647(f) are misdemeanors. PC 69 is a wobbler - it can be files as a felony OR a misdemeanor.

I guess that's the beginning of the elements of the PC 647(f).

Well, there's the PC 148.

Contrary to popular belief, we generally don't like to get hands-on with people. What he told the girl was not necessarily an indication that the officer did anything wrong.

When you ran your mouth, I'm guessing you made some pretty serious threats against the officer or struggled with him (this was the PC 69).

You need to speak to a criminal defense attorney. If you beat the charges, then you can consider suing the police department. However, experience tells us that drunks don't usually win lawsuits that result from their drunken sprees.

thanks for the response what do u think the chances are of jail time? And how credible can threats be when you have just been knocked cold and are strapped to a gurney?

Jail time in this case is very likely if they file on all charges. However, most counties will drop all but the public intoxication in incidents like this, but it really depends on the details of what you said or did with that PC 69.

And how do you know you were knocked cold? You say you don't remember much about the incident, that could be from your inebriation. And chances are you ran your mouth or fought with the officer BEFORE you were strapped to a gurney.
