Drunk in Public VA

What is the name of your state?
virginia

I had been arrested for drunk in public in October 2003 stayed in
fairfax county jail for the night and then later pleaded guilty and
paid my fine.It was a class 4 misdemeanor.

Since then I have lost my job recently and am looking for jobs
so when i fill out the application forms do i need to mention this incident?
Is there any way that I can get this purged from the public systems
so that someone doing a background check on me doesn't find this out?

I am in a similar boat, and since you plead quilty...probably can't get it removed, and yes you do have to put it down if they ask if you have ever been convicted of a crime.

*** Depends on the question asked.
For example, if they ask if you have been arrested or convicted of a felony, the answer would be no.
If they ask if you have been arrested or convicted of ANY crime, the answer would be yes.

*** In a cursory review of the Virginia statutes, it does not appear that a conviction, even misdemeanor, can be expunged. The applicable statutes can be found at:

Depends largely on the type of job you are pursuing. For example, if you are wanting to deliver newspapers, probably not. If you are wanting to become a truck driver for a liquor distributor, maybe so. :D

*** Just be honest with the potential employer, admit your error and that you have learned and grown from it.

stay in the public record?
Don't these people purge misdemeanors from public record after a couple
of years?

*** Nope. Just like any other criminal record, it stays forever. Hell, people can still go back and pull up the entire criminal record for Al Capone.... and maybe even Julius Ceasar!

Clearly no one can answer that. Not all employers use the same hiring 'standard'.

True. But as an IT person myself I can tell you right now that in such a competitive field any mark against you is likely to impact your career advancement. Although I have to say a Drunk in Public is pretty petty so it may not be have any real bearing.

I do know several otherwise smart IT people who had what they thought of as small drug related "hiccups" on their records and they had to leave the field because they could not find jobs anymore.
