Is This Embezzlement?


What is the name of your state?Florida


When I told my business partner that I did not want to be partners any more ( She was spending to much money in my opinion). She took checks and charge slips and instead of depositing them in the bank she went back to the customers that had purchase our product, and exchanged them for cash. All the charges and checks were made out to the business name. I filed two complaints with the police and nothing was done. I went to the States Attorney's office and the person I spoke to said he also did not understand why nothing was being done except that maybe the police had Bigger Fish to fry. The total was $575. She also took another check made out to the company name ( totaling $275. ) added her name and deposited it into her account. Is there anything I can do besides hiring a lawyer that I can not afford. (All the checks and charges were made out to the company Name. This account was in my name only. She said we should do it that way because of taxes. )

Do you have copies of the checks etc? Adding her name to a check and depositing it into her account seems to fall under one of several categories, the other is money laundering on a small scale, have you reported it to the bank? If it is a federal crime report it to the FBI local branch. That may be why local law enforcement isn't working on it. Tax reasons? Tax evasion? Report, report, don't get caught aiding and abetting. $850 should qualify as grand theft but check Florida statutes.

Since this person was an owner of the business, and they opted to exchange cash for the checks previously written (something they coupld otherwise have done in the firts place as an owner of the business), there is no obvious crime for the police to deal with here. The business got its money through him.

If YOU are out YOUR share of the money, you might need to start a small claims action against him.

The only one that MIGHT be a criminal act that I can see here (from across the country and without all the details) is the one where your partner added their name to the check made out to the busines. But, as a co-owner o fthe business, that may not qualify as embezzlement ... I know that our DA here wouldn't prosecute it, so yours might not either.

It sounds like its time to dissolve this business partnership.

I cannot get copies because she deposited the check in her account. I have found in this life "What's fair is not always law". Thanks for the info. We have already gone to small CLaims Court. She stole that money then turned around and tried to sue me for money she spent out of her pocket for the business ( which I told her over and over not to spend). She got nothing in the settlement. No more partners for me! Thanks again.
