My friend was pulled over in his vehicle in Tennessee and taken by the police to his apartment where they searched and found illegal drugs. They had a probable cause warrant. The warrant stated a time to search the premises as 11:30 p.m. on that day. They searched the premises at 7:30 p.m. After they found the drugs, they neither arrested him nor read him his rights? He went to court a week later on an unrelated charge where he had bonded out and his bond was revoked. He is now incarcerated and facing two charges and needs to know if the officers acted within their rights with the search and the non-arrest and non-reading of his rights. Will this evidence be admissable in court? If not, can the charge be dismissed because of their actions?

Please hold the warrant up to the monitor so we can read it and advise accordingly. IF you do not have a copy of the warrant, then go get one.....

They dont have to read him his rights.
They had a probable cause warrant. The warrant was the only thing they had to have. They were completly in there rights.
The charge wont be dropped. They had a warrant!!!
