false arrest?


What is the name of your state? Louisiana
One day the Sheriffs narcotics division, FBI, DEA, ATF and Medicaid raided my office. A tipster had told them I was manufacturing demerol and selling it. They searched both my office and my home (literally tore them apart) and did not find anything. There were no drugs (I don't keep Schedule II in my office), there was no manufacturing equipment and they could not find anything but syringes and needles that I used to give shots with. The Sgt. in charge of narcotics said that was drug paraphenalia. He also got angry and told me he did "not like doctors anyway", we were "all a bunch of druggies". Then he arrested me and paraded me before TV and the press. Then they took me to the jail kept me in a small room for about an hour. Then they booked me into jail. My attorney got me released on my own recognizance. I have never been formally charged or indicted. That will be over a year ago in September and I still have this cloud hanging over my head. It ruined my practice. I think my Civil Rights were violated. I think they are still being violated. What are my rights assuming that I have told you the exact facts?

My attorney does not want me to make waves until after I am completely cleared; but he does not know that I am aware that by that time I will not be able to sue. So is he giving me good advice or is he trying to avoid a Civil Rights suit against the local Sheriff?

did you tell your attorney that you believe your civil rights were violated? If yes, what did he say?

Is your attorney a criminal defense attorney, civil attorney, both?

Maybe you should consult with a civil attorney.

He is a criminal attorney. I was told that most lawyers do not like Civil Rights because they are a pain in the butt. I can empathise with that. It is a pain in the butt to be falsly arrested. None of the local attorneys want to handle it.
