felony firearm possession

My boyfriend was relieving himself in the parking lot of a closed establishment when two cops pulled in behind the vehicle he was driving (the Jeep belonged to a friend). they exited their squad car, guns drawn, and ordered him to kneel & put up his hands. There are many facets to this incident but the main point I would like to make is that the car was searched (without my boyfriend present) and a gun was discovered under a pile of papers on the passenger seat. My boyfriend is a habitual felon and considered a career criminal. However, he has never had any other convictions other than B & Es, and the last one was committed 13 years ago. He is currently being held in the county jail and has beenfor seven months. We cannot afford a private attorney and his PD has done basically nothing at all. I have just heard through the grapevine that the DA is planning to indict him on Federal charges. The price of that private attorney just went up to about $15,000 (minimum). My hands are completely tied at this point and feel that noone is going to assist me...ANY advie would be greatly appreciated!

Get a new boyfriend. This one's going away for a long, long time.

**Any advice at all? Winners hang with winners; losers hang with losers. Forget about him and get a new boyfriend.

Don't you think it would be totally insensitive and weak of me to leave him when he needs me most?

NO. His needs don't matter. This is YOUR life. Why spend and waste it with a loser. I'm sure Ramoth is right - he's going away for a long, long time.

I am the only person in the world that cares about him at all...his mom works in the jail and has not so much as acknowledged his presence there since he arrived. It is killing him.

He obviously wasn't thinking about you when he decided to drive around with an illegal firearm in his possession.

Regardless, legally there's not much you can do to help him. A good (expensive) attorney may be able to get him a lighter sentence than he would get with a PD or by himself, but he is still going to spend a long time in prison, and whatever you feel for him now, he will not be the same person by the time he gets out.

Actually (and I know this makes me look pretty stupid) but he's been in & out of jail almost nonstop since he was 15, so I don't think his personality will change that much. Unless I'm being totally naive, which I may be. Anyway, do you know anything about federal prisons? Are they alot worse or better than state institutions? Will I get contact visits with hi, how long will I get to stay, etc.?

Listen, you have been told personally what to do. If you are not intelligent enough to realize that this 'kid' will never change until or unless he either kills someone or IS killed, then you deserve each other.

Legally, you have no question and are not a part of his legal battle. Therefore, your questions should either be directed at him, his attorney, the judge or the warden of the prison where he is headed.

Or, to your psychologist when you finally realize that you are seeking out failure in your own life for whatever reason.

Okay, lets cut to the chase on this one..... either he is lying to you.... or you aren't telling the full story on this forum.

You said, "My boyfriend was relieving himself in the parking lot of a closed establishment when two cops pulled in behind the vehicle he was driving (the Jeep belonged to a friend). they exited their squad car, guns drawn, and ordered him to kneel & put up his hands."
*** That is what is called a FELONY stop. It is only used when there is a high probability that the 'subject' is armed or considered dangerous. Clearly, the officers coming up on a guy taking a leak in a parking lot would not warrant a felony stop. There is FAR more to this 'innocent' version than either you know..... or are telling.

"There are many facets to this incident but the main point I would like to make is that the car was searched (without my boyfriend present) and a gun was discovered under a pile of papers on the passenger seat."
*** I find it interesting that you make NO claims of the weapon NOT being his, so we have to assume that it was.

"My boyfriend is a habitual felon and considered a career criminal. However, he has never had any other convictions other than B & Es, and the last one was committed 13 years ago."
*** Gee, that simply does not 'ring true' in light of your later post that "he's been in & out of jail almost nonstop since he was 15", does it??

"He is currently being held in the county jail and has beenfor seven months. We cannot afford a private attorney and his PD has done basically nothing at all."
*** And exactly what would you expect the PD to do??? Simply, your 'soon to be ex' boyfriend is guilty as hell. That kind of limits what actions the PD might have, huh??

"I have just heard through the grapevine that the DA is planning to indict him on Federal charges. The price of that private attorney just went up to about $15,000 (minimum). My hands are completely tied at this point and feel that noone is going to assist me..."
*** And exactly what 'assistance' are YOU expecting??? Sounds to me (and apparently a lot of others on this forum) that the best advice YOU could get would be to get some self-confidence and realize that this guy is clearly an anchor around your neck..... get rid of the loser!! As for advice for him..... don't drop the soap.

ANY advie would be greatly appreciated!

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

I can see that some of you people are on this site for is to judge others and tell them how to live their lives. Although I don't owe it to anyone, I feel I should explain a few things (I was trying to give the abbreviated version, but obviously that's not allowed). First of all, the reason he has been in & out of jail his whole life is because after he committed his last B & E in like, 1992, he did violate his parole and probation several times by moving w/o telling his P.O.. As for Jetx's comment about why a felony stop was excecuted, that's one of the main things that I don't understand...what reason would the cops have to do that unless a) my boyfriend is leaving out part of the story or b) the cops in this town (who know him very well, for what I'm hoping are obvious reasons) have it in for him. Basically, if anyone out there can disregard all the other details of my story and just tell me in semi-certain terms what to expect, I would appreciate it.

I think I already told you what I think is going to happen, but I'll try again:

He's going bye-bye.

My response:

You're not telling the whole story.

You said, "My boyfriend was relieving himself in the parking lot of a closed establishment"

"but he's been in & out of jail almost nonstop since he was 15"

"the reason he has been in & out of jail his whole life is because after he committed his last B & E in like, 1992, he did violate his parole and probation several times by moving w/o telling his P.O"

He wasn't JUST relieving himself. He was probably caught in the midst of another B&E.

What is it with you women who find criminals so fascinating? Undoubtedly, you're just a criminal, ner-do-well, yourself. Or, you live in a trailer.

My response:

So much for criminals, like yourself, who don't place themselves in the category of "Skank". Where's the trailer in this story of yours? There's gotta be a trailer!
