Felony theft chargesWhat is the name of your state? Arkansas I was caught stealing from my job and I'm being charged with felony theft. I'm 27 years old and I have no prior criminal record. I have a court date for next Tuesday and I'm wondering what the chances are of being convicted and sentenced to jail. I don't know how this works because I have never been in this situation. I was told I can not get a public defender until I go to court. Is there a likely chance this charge will be dropped to to something less with me paying restitution and fines. I'm just worried about going to jail because my wife and I are due to have a baby in April. Any advice will be welcome. |

| When you get to court, ask for a public defender. Then ask your lawyer all your questions.

another questionwhen I got to court do I ask for a public defender before or after they ask me if I'm guilty or not guilty. I know this might seem like a stupid question but like I said before I have never been in this situation. |

| It really depends on the amount stolen. It appears that you have no criminal record. That will be in your advantage. You can likely get a plea bargain to a misdemeanor or a lower felony and receive a much more lenient sentence (maybe community service, restitution, fine instead of jail). |
