What is the name of your state (only U.S. law)? AZ

My boyfriend was stopped for excessive speeding and arrested. His truck was towed and we picked it up the next day. He told the police his gun was in the truck and they said he could get it the very next day. No one was there to release it when we went there, so we decided to wait till after his court hearing. At the hearing no charges were filed against him, although the state has 7 yrs to file charges. Went to the police department to pick up his gun and now they tell us that they are holding it for evidence because the case is still pending. Does this mean it will be 7 yrs until he can pick up his gun?

Are their pending charges involving the firearm? If not, I do not understand how they could lawfully retain custody of it unless it is registered and to someone else.
