are filed in a criminal case, should an arrest be made or the accused be notified prior to a press release .

My response:

No. There is no legal or moral compunction for the reporter to contact anyone incident to an arrest. There is no requirement to "get your side of the story" or to "ask permission" to print the factual news of the day.
