Question

Fugitive File vs Fugitive From Justice


What is the name of your state? Virginia


Is there a difference between the terms "Fugitive File" and "Fugitive From Justice"? Are they handled differently by Law Enforcement and the courts?What is the name of your state?

Neither is a legal term (at least in Virginia).

What is the point of this question?

Someone failed to show twice for a Show Cause hearing on a Class 1 misdemeanor DUI conviction (probation/VASAP violation), the first time a Capias was issued for Failure to Appear and the second time the judge stated it to be a "Fugitive File" which it is now noted as being in the Courts Case Information. I understand the warrant for FTA remains outstanding until served and the SC remains pending until the Defendant is brought to trial. I am unclear as to whether the individual is considered a fugitive and will be actually sought out by LE (at his last known residence, employer, etc) or whether it will just be one of those deals where if he happens to get picked up somewhere he will be arrested for the outstanding capias.
