Getting my stuff from evidence

What is the name of your state (only U.S. law)? South Dakota

The police took my stuff for evidence from stolen vehicle i was in and my case ended in two months ago. I tried to get my stuff back but they keep doing back and forth and wont give my stuff back. Can they legally do this? They say because someone is on the run they dont want to release my stuff but my case is done so i dont get how they can keep my stuff. What can i do?

Apparently YOUR case was dismissed but the CRIMINAL CASE was NOT. That is the KEY!!

You will have to wait. Or hire an Attorney to deal with this.

IMO NOT till the State is "done" with it. But feel free to consult with a local attorney. Can''t hurt...
