GTA/no bail/victim drops charges/still in jailWhat is the name of your state?What is the name of your state?What is the name of your state? Tennessee/California My daughter, 19, visiting a friend in TN, left with her friend 20, in the friends car that her mother has provided for her use, to go on road trip to CA without asking/telling mother that they were going. After several days mother files report that car is missing along with the girls. The girls are located in CA, arrested for Grand Theft Auto and booked into LA county jail. They have been there for 12 days so far. They have not had an arraignment, no bail as ever been set. They had an extradiction hearing after 7 days and signed a waiver for that. They are still there and the mother has told everyone that she is not pressing charges, pursuing any kind of action against either girl. But CA won't release because TN claims they want girls back. Should there have been a bail set? Is there a case if the victim(Mother) refuses to proceed? In the meantime, both girls, no previous criminal problems,are sitting in jail, scared to death, not knowing what to do and I am in Indiana, unaware of what laws are in both states and officials in both states have different answers to same questions. What should we do? Help |

| State to state extradition takes time. No bail needs to be set because they are in custody awaiting extradition -- and obviously, if they fled once, they are a flight risk. My guess is, just because the mother wants the charges dismissed, the DA's office probably won't do it because of the hassle they had to go through in order to file it all in the first place. |

| Tennessee They did NOT flee once. They were really going on a trip to visit family. The daughter had use of the car all the time. She is almost 21 years old and didn't tell her mom that she was leaving. Which is why the mom called the police, she wanted to find them and see if they were ok. She isn't even concerned about the car. She hasn't gone to pick it up and it has been 4 weeks. Is there a time frame that they are bound to to get the extrdiction done? Or can it drag on forever? They were moved from the LA county jail, 2 weeks ago , to San Bernardino jail, and then 1 week later, they were supposed to get on a plane to Oklahoma to head back to Tennessee, but after waiting 5-6 hours and being processed out, they were told the plane was full and sent back. What is up with that? Can this continue indefinitely? Thanks |

| It can likely continue until an attorney intervenes and files the appropriate paperwork to either force them to release or transfer her. But, as has been mentioned, these things do take time. And the authorities in CA are not in a position to drop the charges based on a warrant out of TN. If someone can convince TN to drop the charges, then that might expedite matters, but CA cannot do that. Carl
