In a case where a religious university employs a state organization (police department) are there grounds to have an arrest thrown out because of this sort of combination of church and state? |
My response:
No. A "religious university" is, under the law, still a legal entity - - a separate legal "person." As such, it is perfectly entitled to hire anyone it wants to hire.
Besides, the hiring of officers and subsequent arrests have NOTHING to do with the school's religious doctrine or internal working affairs; i.e., it has nothing to do with the academia or the religion itself.
