What is the name of your state (only U.S. law)? alabama

March 27, 2009 my landlord brought a piece of paper to me that he had typed up himself, it was not a legal document at all.
The piece of paper stated that my husband and i must be out of the house we had been renting from him by March 31,2009 and if not
he would be there at noon and he would shut off the elecricity and water and remove our belongings from the house and pile them in the
yard. I have a copy of the Alabama landlord tennent handbook and I know that this threat of his was not legal and i had more time.
My parents believe that i was picked on because my husband and I are white and there is only blacks in that neighborhood and no other
whites have ever lived in the area. I dont know if that was an issue or not but i do know what took place 3 days later is still completely
unreal to me and We were treated worse than a pack ok wild animals. If the landlord didnt want us there we would go but it would take a
week most likely. We have no vehicle, my husband had no money because he lost his job a month ago, no one to help us and no where to go.
On the 3rd i would be getting a check as i do every month since 1991 from social security because I have bipolar disorder and a chronic pain disorder.
We would have to wait at least for that so we could at least rent some where to store our things and hopefully find some place to stay.
We have only lived in alabama for a few years and dont have many people that we can depend on. We would have moved given sufficent time to make
proper arrngements. I wasn't very worried because I knew there were laws and things would be ok.
Things were not ok though****************************. And I can not believe what happened next **************... On the 31st the landlord came down to the at noon as
promised and he brought a police officer from the small town we live in. My husband and i stepped out on the front porch to show
the officer the typed letter from the landlord and the alabama law reguarding the evictions. Willie (the landlord) said he did not care what
law we thought we knew he was the law when it came to his house and we were about to learn that he was the man around there. I being
confident the law would be followed told him it didnt matter if he was the man i would be there maybe a week but would go and he would not
touch or move our things. I asked the officer if he would tell the landlord that he must follow the laws and there are processes and offered
him the alabama landlord/tennent handbook.(he was a young officer and i thought maybe he was not aware of the rules. The officer looked
at me like i was illiterate white trash and told me he knew the law and didnt need me telling him anything about. I asked the officer to
tell the landlord to leave. The officer said he was only there because willie asked him to be as he took back his property. He said he had
nothing to do with the eviction i could deal with someone on that. So i asked the police officer to call his boss the Chief (my mother had talked
him the previously that morning and night before and he said we would come over if need be but he & his officers would not get involved.
willie once again telling me he dont care i am moving if i like it or not. In my mind i started it panicking, so i walked down to middle of
yard getting very nervous and not knowing what to do i starting walking back and fourth across the yard... the landlord and officer standing
at top of hill carrying on laughing and i felt extreme fear didnt know what to do and as i walked back and fourth my mind was racing and i didnt
know what to do...talking with myself as at times when upset or scared i have been know to do I was saying that i was going f----ing no where, i thought
it was the landlord harrassing me more cause one of them loudly said something to me... i replied "god dammit" leave me alone the officer ran down the
hill bum rushed me grab my arms yanked them behind my back cuffed me tight as he could and said "you are going somewhere now to jail and i was
put in the back of the police car and going to jail for disorderly. Not 3 minutes passed as landlord is laughing and saying untrue things
bout us ...the chief of police pulls up and then 2police cars from the neighboring town and the cheif from neighboring town who also runs task force
with his canine dog arrive. My husband said they asked him if there was anything illegal in house and told him he better tell them now and then proceeded
to go in my house without a search warrent or permission a minute passed and my husband was handcuffed and put in another police car.when they stepped in they
looked at ash tray and thought they found marijuana roaches as i said we were broke husband had been smoking rool your owns. so for next 20-30 minutes while
we were cuffed in back of cars the officers and dog searched our home (the dog found nothing) . they got us both out of cars told my husband there was paraphinella charges on him and i had the
disorderly but they would be nice and we would have no charges if we were gone within 24 hours. and they took a bottle of constipatation medication out of
bahroom cabnit and told me if it came back as meth, they would have to charge me it definitley wasnt.
my husband and i are 38 years old do not and have nevr had a drug charge. we left we cant afford o go to jail.... lots of our belongings got thrown away destroyed or lost in the rush to
move which was very hard w/out transportation. So we have lost a lot due to an illegal eviction, we are now homeless staying in a hotel i am a nervous wreck. what can we do? I wouldnt
treat my worse enemy his way. and what are the police gonna threaing us with them charges whenever? Can you pleas give us some advive. we live in alabama.
