I know my username is probably all over this site I've got problems. Back in theMay my fiancee' was arrested for child rape. We've been together for almost 2 yrs now but last yr he cheated on me with another girl. He was living with her and took care of her kids. We broke up for a short time and then got back together even though he was still living with her. He basically found out how crazy she was and unfit of a mother she was (she would send her kids to school unbathed and dirty). He stayed because he knew she was crazy and for the benefit of the kids even though they were not his. Now she knew that we were still dealing with each other because she made threats to him about me. She said that if he broke up with her that she was going to have me jumped and beat up. Well then she found out I was pregnant. He finally broke up with her and left. Now all of a sudden she got him arrested saying that he molested her daughter and that I happened at my house. First she started with her daughter and now is saying that it was her son also. The cops went into my house, left a search warrant on the floor and took my curtains, towels, washcloths and some pornos that I had. I was not home when this happened. All because this woman made her daughter say that when he was done he wiped the semen on the curtains and towels and made the kids watch pornos. The kids described everything in my house even down to the couches. Why or how they knew? Because I bought the couches and curtains from their mother (the girl that he was messing with). At the time he told me that they were just friends. I never knew who this girl was up until now. This is not the first time she tried this. He tried to break up with her before and she made her daughter say the same thing but there was no outcome because at the last minute the child admitted that she lied because she didn't like the way he disciplined her. Now he can say that the two children were caught messing with each other by him and when he brought it to the attention of the family nothing was done. But now its being used against him. He's been around children all his life. He has a gang of nieces and nephews. How I know? I met them all. He's a good father and I know that he did not do this. He's locked up now for a probation violation and due to go to court for this the end of this month. I'm talking to two lawyers now. Please help!! What should we do? Yeah it was his fault for cheating on me and being with this nut but he has every right to be home with me and his new daughter.

Let his attorney handle things. Aside from that stick a fork in me, you're too much on a Sunday morning.

Does anyone know how much it would cost to beat this case just in preliminary? I'm going to talk to two different lawyers to get their feedback. I also have a few people that I can get affidavits from on my fiancee's behalf. I just want this to be over and done. Is there anything else I can do besides pray?

His attorney can do all of this. If YOU get information, anything that plays against him is NOT confidential.

An affidavit is useless if the person writing it is not present at court to take the stand and say what he or she saw. If the person providing the affidavit has no first hand knowledge of the incident, then their contribution is pointless, anyway. People that are willing to say he's a wonderful guy are not witnesses in a criminal trial.

As for how much it might cost, that depends. I am in CA and not PA, but out here, for this kind of a case, I'd say the cost would be between $5,000 and $7,500 and that would be if NO expert witnesses were called to testify. A case like this could easily rise to $10,000 or more if expert testimony is required.

Speak to those attorneys and see if they will agree to speak to the defendant. Understand that anything you know is not protected by spousal privilege. You will almost certainly be called as a witness by one or both sides, and you will have to say what you know. So, the less you KNOW about what happened and the less you can testify as to who said what, the better off you might be.

Let whoever he hires as an attorney do their job.

I do plan on testifying. I'm the only one he's got. Now the child that was just put into this, I know his father. Of course he has no idea that this was going on. Could he be used as a witness because that is his biological child and if he was molested he would have known about it correct? He dosent deal with the mother at all. Would he be creditable or no?

Let the defense decide who to call. Being a parent does not mean he knows what happened. Some kids don't talk to their parents.

The less involved you are,the better. If YOU start talking to potential witnesses, there can be all sorts of problems ... from allegations of witness tampering, to potentially being asked about what those witnesses told you (particularly if the state believes they said something different to you than they said on the stand).
