Question

I want it off my record


What is the name of your state?undefinedTX

I recently got divorced from my wife. When our breakup began, we had a fight. My wife spat in my face, and I slapped, once. I left the house, and while I was gone, she called the cops. When I returned home, I was arrested and charged with assult. I had no money to get a lawyer, and the judge didn't provide a court lawyer either. I sat in jall for 5 months, before I finally pleaded "no contest" and the judge gave time served and released me.

No it has been a little more than a year since I was released, and I am unable to gain employment due to the Misdimeanor Assalt charge in background record. Is there anyway I can have this charge expunged or removed off my record? I have been turned away by so many businesses as a result. What right to I have? I am unable to support my children because of that dumn ass ex-wife of mine.

Who lives in the trailer?

Does she have a lot of tattoos?

Is she a "skank"?

If you spent five months in jail, then you are not telling the whole story. This forum does have active attorney's who post here, and I assure you, you will get no help with that story.

Get it off my record


I left out a good many details from my synopsis of what happened, but the facts remain: I did not beat or abuse my wife, i sat in jail for a few months, I pleaded "no contest" against my will in order to be released, I now have a misdemeanor assult charge on my record.

My wife wanted assistance so she said I beat her that day. I was unable to find representation, so I was screwed.

That is all aside from the question I want answered. How do I get this charge expunged/removed off my record? I need a job and cannot get past this background check that all major corporations perform. Help me out please.

Have you tried typing that term "expunge" and "TEXAS" into a search engin and pressing return?
I think you are just not trying and don't want to work or pay your child support, keep it up and you will end back in jail.

Some of the replies to your problems are the result of diarrhea of the brain, IAAL in particular.
Obviously, the admonishment to say nothing if you can't say something constructive was lost on him, along with such expressions as human compassion, human decency and appropriate humility. There is an appropriate icon for IAAL, but I cannot find that particular finger on this selection.
I do believe that copies of his wisdom should be sent to the forum moderators.
What you went through with your wife is NOT unusual. If you want to know of others who have suffered as much or worse than you, look up [url]www.ejf.org[/url] or search for Equal Justic Foundation, Dr. Chuck Correy is the monitor.
You will find situations where a man in jail was arrested for violating a restraining order when his girl rethought things and went to visit him in jail, USING A FALSE NAME AND ID.
Yes, the DA did try to prosecute!
Another man was arrested because his ex wife saw him in another car on the same highway, GOING THE OPPOSITE DIRECTION! She used a cell phone to 'report his violation of the 300 foot rule' -and he was chased down and put in jail.
Here in Covelo, "Mike" was threatened with jail for being on Mina Road, for violating the "300 foot rule" - and when I, the nitpicking a$$ went out and measured the distance of Mina Road from exwifes house I found it to be a minimum of 326 feet.
Oh, you can do a LOT longer than five months for violating a tro or ro!
Tip, get a digital recorder and wear the sob around your neck! If she comes up to you - believe this or not - you can go to jail because you are within 300 feet of her, even if she sought you out!!!
