Inapropriate Texting with Underage Girl

A co worker of mine recently got a phone call from an irate Mother threatening to have him arrested. It seems he was texting her 16 year old daughter. (he is in his 30's) According to him, the text's HE sent were all normal and friendly, however SHE sent him a text including a topless photo of herself. He swears he did not ask her to send this. He only replied with "nice". (says he deleted pic immeadiatly)

Can he be arrested? How far will this go?

p.s. don't ask me why he was texting a 16 year old, I don't know and told him that in itself was immoral in my eyes!

Wrong move. Depending on the conversations, that is a yes or no answer.Can he be arrested? How far will this go?

If he has kept a copy of the image, then he is guilty of possession of child pornography.

According to him, his text's were "harmless", in my opinion with the exception of the "nice" comment.
He also said he deleted the image immeadiatly.

In my opinion, commenting to a 16 year old that her naked breasts are "nice" is EXTREMELY inappropriate!

He was trying to say his texts were harmless and I was stating that I disagreed.

If your friend is worried about this then he's probably done more than text "nice" to this sixteen year old.

You're and idiot, or rather "your friend" (wink wink) is an idiot and the sixteen year olds mother is an idiot for allowing her sixteen year old daughter to have any device she can use to communicate with grown men, at her disposal.

If I had a sixteen year old daughter and I discovered she was texting middle aged men, she'd get to use a cell phone when she turned 18, found herself a full time job and a her own place to live.
If I discovered she was sending them half naked pictures, she wouldn't be leaving the house until she was 18!
I would also text this guy from her phone with a few photo's of my own. One shot of my 45acp next to a shovel and shallow grave, one shot of a handcuffed subject getting beat with billy clubs while being castrated and one last shot of Bubba bending his cell mate over a bunk while holding a pillow over his face.
The text message would ask him which of the activities depicted in the photos, would he like to see himself participating in and that if he ever sends a text message to my underage daughter again, the choice will be made for him.

Now change your cell number and only text women your own age!

I'm not being naive, I simply did not want him telling me any of his so called "reasons" for texting a young girl. Also, not my "friend", just a co-worker.
