Just wondering


What is the name of your state?MA
Hi, Just a few questions that maybe someone can help with. Years ago (maybe 1990) I was living in Philly and got arrested for poss. of a firearm. I think it was called FICO? Long story short, I applied for a permit to carry and it had not been approved yet. I plead no contest and was put on 12 months ARD. and was told the charge would be expunged.

Fast forward, I returned to live in Mass and have a current Permit to Carry for all lawful purposes. My current job has me traveling through MA, NH, Ri, ME, VT and CT. I could drive through 3 states in a day without knowing when I leave my house if it will happen.

Now to my questions. Does this still show up on a record check? My local police chief when I applied for my current license asked me about it because I put it on my application, I don't know if it shows up on a background check. The reason I ask is that I am Planning on applying to these other states to be in compliance with the law. I currently have a car mounted gun safe in my car and if I have to leave the state, I pull over, unload, lock the gun with a trigger lock, and then lock the gun in the safe in the trunk. I'm sure that no one would ever see it or have access unless they stole my car and stripped it for parts and come accross it by accident and then spent the time drilling out the safe. But I want to do the right/legal thing. FYI with the exception of A&B charge for a "bar room fight" where all 10 people in the bar got arrested in '93 (the silly things we boys do when we are young and the case was "continued with out a finding"). I have NEVER been in any other trouble

Thanks Bill,

I've been on that site before and thats where I got the download applications for the other states. But my question still remains.

Does my 1990 arrest still show up on my record? After it is Expunged (sp?) is it gone forever? I'm sure that if I was to run for President, or head of the Security Commision , that it would turn up, but would a background check turn this up?

Expungement doesn't make a conviction go away entirely and is always available to law enforcement, the courts and some background checks, even with expungement you still have to answer quesitons truthfully. Expungement may seal some public access.
