What is the name of your state? kentucky would due process/preliminary hearing /motion to dismiss due to failure of the state to hold a preliminary hearing within the ten days. is this possiable?

Heres more detail defendent(1) and (2) arrested and arrainged . Both defendents requested and were granted public defenders .a preliminary hearing was set for 7days later at which time defentent(2) entered a plea and was bound over to the grand jury. public defender withdrew from representing defendent (1) on the grounds of conflict of interest due to conflicting stories between the two defendents;so the state had to seek a lawyer outside the publicdefenders office so a new preliminary hearing was set for seven days later for defendent (1) at which the state had not obtained a lawyer and yet another date was set . is this grounds for dismissal based on the states 10 day statue for a preliminary hearing. please respond
