Larceny from a person

What is the name of your state? michigan

My 17 years old son was charge with larceny from a person with up to 10 years charge. He took a bag from a girl with marijuana in it. She told the police that it was 40 dollars in it and some make up. My son told the police that she was trying to sell him drugs and gave him the bag to take it but he took the bag and left. All his friends told the police that they saw the bag and drugs in it.

They offer my son the plea misdemeanor for up to 1 year in prison but it will stay on his record for 5 years. This is his first offense and I think they went to far. Should we take the plea
