Is this legal?

What is the name of your state? Mississippi

I was sitting in my car parked in my mothers driveway, a cop rides by and sees me so he backs up and ask if I live there. I said yes, he wanted I.D. to verify this, so gave him my licence. The rookie that he was training looked in my car and saw a beer can, I told them I had been drinking. The rookie the tells the other officer that he smells marijuana. They place hand cuffs on me and begin searching my car where they found 2 roaches in the ash tray. can they do this even though I was parked on private property?

Yep.

Now, for your own education look up the definition of "Probable Cause" and "Reasonable Search and Seizure".

**A: I gather you are looking for a loophole and a "get out of jail free" card?
