legal search or not? What is the name of your state? Minnesota I have a friend who has a warrent for his arrest in Minnesota. He is no longer living with his girlfriend in MN, he no longer lives in Mn. The police keep walking in her house to look for him. I am not sure if they knock first or not. It didn't sound like it but, I know for sure they dont have a search warrent or at least are not presenting one to her. They just walk in. Is this legal? Is there a difference between a search warrent and a bench warrent? If so what? |

| Q: Is this legal? A: Yes. Q: Is there a difference between a search warrent and a bench warrent? If so what? A: A search warrant gives the cops the right to search and seize something. A bench warrant is an order from a judge for the cops to pick up someone.

| If the police have a warrant for someone's arrest, and they know where he is, they can go there and get him. If they don't know if he's there or not, they can't go breaking in on a guess. If she's told them he's not there, and they keep coming back, I'd suggest making a complaint. |
