Locked box in a car: Is it safe from search?California: Hypothetical question: Car is stopped for speeding or other minor vehicle violation. Investigating officer requests search of vehicle. Search is declined. Car detained until K9 unit appears. Dog makes 'positive' hit. Entire contents of car are searched but no drugs or paraphernalia are found. Locked box is found in trunk of car (which was also locked). Driver, passenger don't have key to lock. It could be a gun or anything else one would keep in a locked box. What rights does the driver have regarding the box and its contents? Let's assume that the dog does not 'hit' on the locked box.

| What class is this for? The answers are fairly obvious, though some variables have to be applied because details are lacking. As SJ mentioned, we do not (usually) do homework. And thi sis a rather easy subject, you just have to look up a few things. - Carl
