Military searches/Inspections?


I live off post in a hotel that was leased by the Army for soldiers. i never signed any statement saying they could come in my room any time they wanted to search through my things. The military likes to conduct "Health and Welfare Inspections." This is when a member of the unit, acting in the official capacity a governmental agency (the US Army), and searches your belongings for anything that is against the barrack rules. This may include weapons, pornography, large quantities of alcohal, and contraband deamed illeagal by the US Government. I am also a police officer, so I know that leagaly, they should not be entering my room and going through my things, unless i give verbal or written consent, or they have a warrant. Can you tell me if they are allowed to enter my room and search my possessions against my will, if I live in leased property by the Army

Does it say anything in your lease regarding this? You may want to re-read your lease to see exactly what you are in for; however, since you are not part of the military, but are a civilian, this doesn't sound right. Have you talked to the owner/management of the hotel?

The Army is paying the rent, and as such under authority of the UCMJ, may search the room. You have two options, move or live with it.
