My daughter was arrested because she had an open container of Mike's hard lemonade--she was sitting in her boyfriend's car, he was standing outside drinking beer, there was more beer in the car. What can we expect when we go to court next Monday? |

My response:
1. A hefty fine, plus court costs.
2. About 25 to 50 hours of Community Service.
3. Being slapped by the bailiff.

| | | | minor in posession of alcohol define "hefty" - this may be beyond your scope of expertise but..what do I do about the boyfriend's asking my daughter to say she had not sipped from her container so he won't get in more trouble for having supplied her with the "lemonade"--he's a 19 year old looser? I've told her she will be under oath (not sure if anyone will ask where she got the bottle) and that perjury is a big deal--to take care of herself and let him swing in the breeze--which I am hoping is gale force by now. |

Tell her to tell the truth as best as she can, perjury will result in her going to jail, and she don't want that to happen, does she? |

Back from my daughter--the boyfriend has said he will say he does not know who put the alcohol in his car (someone borrowed it during a lunch break)--my daughter knows the "supplier" is father of a four year old and in trouble with his wife(?). The boyfriend has told her again not to nail him. She's finally starting to get angry. Old fears about the crowd my daughter aligned herself are starting to crop up. The last time there was this sort of trouble, Marianne Measles, 13 at the time, threatened to file statutory rape charges and wound up dead. My daughter (who is the same age Marianne would have been) reminds me the murderers are the last generation, not hers and her friends would never do such a thing--I'm not so sure. Should we hire a lawyer after all? |

| | | | measles sad, isn't it--it is a real name..only good I suppose is that she won't be easily forgotten in this area of really small towns where everything is supposed to happen out there in the big bad world. Back to my real world though..should I get a lawyer--somehow to enable my daughter to tell the truth without the boyfriend and his evil entourage making the link? |

| | | | Getting a lawyer is up to you. As your lawyer, he/she will know more about your specific case and you can talk to him/her directly. Also, it doesn't matter if he didn't know the beer was in his car. As the driver, he is suppose to know what's in his own car. Anything found in the car that is unclaimed will fall on the driver. If the boyfriend & friends threaton her, notify the police. If you can tape the threats, he can be charged either harrassment or making a terroristic threat, maybe more. | |
