A university student had one too many drinks. Roommates concerned about the student's safety called police so he could be placed in a hospital (he needed counseling for personal issues with girlfriend that were troubling him). Student agreed with cops to be taken to the hospital so he could get counseling. However, (to everyones' surprise!) the student was taken to a county psychiatric ward, and let free after 6 hours (the ward's physician said he didn't belong there with all the lunatics). This student always had a clean record. Now the student has on his record a 5150. He's concerned that this may affect his future career in counseling. How can this student expunge the 5150 from his record?

'student' should talk to university legal aid for starters.

Also consult with someone in the field to see what the effects of the hold really are...

If need be retain a lawyer.

Where else would someone be taken who needed counseling for something troubling him? It sounds like he was contemplating suicide and if so, the only thing the police can do is bring him in for a psych hold until a doctor assess the patient. If the doctor determines he's not a threat to himself or anyone else, he's released.

Where did everyone expect the police to bring him, to an emergency room to have his tonsils taken out?
