was wanting to know if some one with a mental disablity can be charged with a felione?

I assume you mean "felony".

Their are many types of mental disabilities. The general answer to your questions is "yes".

yes.. but now they have let him go and he is home.. they droped the charges.. but does that mean he will still have to go to see the judge? because the vitime had filled out paper work saying that they were not pressing charges..
 
The state would have to be the one to decide to file or to drop (if already filed) the charges and not the victim. The state may decide to let things go if they don't have a cooperative victim (Unless it's a domestic violence charge.)

But it is unlikely they were dropped because the suspect has a mental disability. A person has to be so disabled to...well a few things depending on the state. But at least so disabled to not be able to tell the quality (as in if it's right or wrong) of his actions.

What type of "mental disability" does the perp suffer? Is there a documented history of this disability? What were the charges?
