Need some advice


What is the name of your state?What is the name of your state? Idaho

I sold a guy something on Ebay for $3500.00. This guy lives in Germany. He asked me to put this item in Storage until end of June. He paid me for it and paid for storage in Oregon - Where I used to live.

I moved to Idaho in March. I thought this was a done deal. In July, I got a note from the storage that the rent was due. I called them and they told me that if I did not pay them, they would auction off the contents of the storage. Obviously the guy that paid for this did not pick it up.


I drove to Oregon and picked up the item.

I tried to contact this guy and got no replies. I needed money because the trip to pick up this item cost me $600 out of pocket and it put me behind on my bills. So, I relisted the item on Ebay and sold it. A week after selling this, I got a call from the guy and he wanted his item. I explained what happened and told him I did not have the money right now, but I would give him all of his money back, but he said he does not want the money, he wants the item. He said it was his and I had no right to sell it.

Now he wants to have a warrant issued for my arrest in Oregon. Once again I live in Idaho and just want to give the guy his money back as soon as I can.

What would you do in this situation. I am not a criminal and don't want a warrant for my arrest.

I will offer my opinion anyway....The guy in Germany is screwed..
I would imagine that if you have all the correspondences between you and the German guy stating that he would pick it up in June and it is now August than I would pretty much say that the item becomes available again and it is a civil matter. It is up to the buyer to fullfill his end of the deal which it sounds like he did not, which in turn is causing you to receive threatening phone calls from the storgae facility. I would say that the German guy can't pursue this criminally, And I doubt the cops would do anything.
I am not an attorney nor do I have an education in 'LAW' so all I am offering is personal opinion.
But keep in mind if I find out you are commiting auction fraud you will be ripped by me on this forum..see thread

Might I suggest move to England? They have prozac in their water. In all seriousness, you have left out alot of info, and Ebay is a touchy situation. I've noticed most on here do not even respond to Ebay issues.

If the rent had lapsed the storage would have sold it also and he wouldn't have gotten it back at all. If the storage was in your name your credit would be affected. If you give him a refund remember your out of pocket expenses.

I don't see how they can get me for theft. He never took possession of the item and did not follow through with our aggreement. Also, I am making every effort to buy the item back from the guy I sold it too the second time, so that I can tell him to come and get it. I have also offered to refund all of his money.

No matter what I do, he will not be satisfied and says he is going to press charges against me tommorrow.

Looks like I am in a world of hurt.
