I was out here for a two week vacation

Ended up charged with

784.07(2)(A) Assault or battery of law enforcement officers http://www.flsenate.gov/Laws/Statutes/2012/784.07
843.02 Resisting officer without violence to his or her person http://www.flsenate.gov/Laws/Statutes/2012/843.02
810.08(2)(A) Trespass in structure or conveyance http://www.flsenate.gov/Laws/Statutes/2012/810.08
856.011(1) Disorderly intoxication http://www.flsenate.gov/Laws/Statutes/2012/856.011

https://forum.freeadvice.com/arrests-searches-warrants-procedure-26/out-bond-kansas-dui-charge-now-out-bond-florida-need-help-583580-print.html (More gory detail in case anyone cares to read it)

Everything was dropped except for
843.02 Resisting officer without violence to his or her person http://www.flsenate.gov/Laws/Statutes/2012/843.02
and now
877.03 Breach of the peace; disorderly conduct http://www.flsenate.gov/Laws/Statutes/2012/877.03
is on there. I understad that to mean that they elected to charge disorderly conduct rather than disorderly intoxication??
877.03 is M2 and 843.02 is M1

I stayed here in Florida and made my first appearance ... the state offered me THIRTY DAYS so I pled not guilty

I really don't understand how the man could knock me down and cause injury to me and yet I should do thirty days ... sigh

Anyway I NEED to go back home for now - I am in a hotel I can not pay for anymore, plus, I want to see my grandmother -- she lives an hour away from me usually, and, she is not going to last much longer.....

Since I am on bond for four charges, three of which are dropped, the bonding company will for sure get $1500 back now ---- right?

I paid $100 minimums on all four charges. All four charges each had a bond of $500 set.
I paid $400 = 20% fee

So when I talk to them, they told me "technically you're not supposed to leave Florida, but I will have the owner call you" ---- she is a very nice lady and I THOUGHT she understood that I was going back... I may have misunderstood

But can I buy my bond from them?? Do they still have $2000 at risk or just $500 now? They also have a very very expensive ring in as collateral and I stay in constant contact with them ..... I sure hope they will work with me .. I have been just beside of myself about all of this with the crazy drunken woman, her son, my family trying to kill each other back home, money problems, you name it .....

How do I find out who the DA is on my case? I would like a chance to explain the situation to him... I think if they knew the circumstances they might dismiss or work with me, but have no idea of who he or she is!!

Edited to show reference links

Thanks!!

Did I post this in the wrong section????
You will need court permission to return to Kansas. IF you have an attorney, talk to him/her. You cannot just leave and go back. If you do, you are violating conditions of your bond and it can be revoked.

Well, I definitely would be back ... I am trying to raise the 2k so I can put it on file with the bonding co OR try to buy my bond from them - can they sell it to me??

Trying to get a hold of public defender, now

PS: In the other thread they said oh you misrepresented your finances and all .... if I raise the 2k it'll be by having someone borrow it, and have to go back to them ... definitely nothing to hide here

so, in the other thread you say you have to return to (I believe) Kansas to report to jail. You also state a person close to you has passed. Any chance that was your grandmother from this thread?

if you do not obtain the courts approval to leave the state (presuming that was one of the restrictions), no matter what else you do, if you do not obtain that permission from the court, you will be violating the terms of your release. That will result in the issuing of an arrest warrant.

If you have a bond holder, the courts will call the bond due. They don't like when that happens.

In kansas I have appeared several times .. 1. Arraignment 2. Status Conference 3. Pretrial which the COURT decided to continue over not having my whole driving record 4. Pre-trial my lawyer asked for a continuance 5. Trial september 13th which my lawyer appeared for on my behalf and got a continuance 6. I need to appear October 29th for Bench Trial - if found guilty, we appeal and go to Jury trial ... no IDEA if it'd be a long or short date

I don't think I fully understand how this really works .. I thought that so long as it is okay with the bonding company, I can go .. The court, I have not seen any terms from them.... I've read my bonding co paper work and it says

I, my name, of my free will bla bla bla do bla bla agree to return to the state of florida, city of here, as a prisoner to answer to these charges __ __ __ __ __ pending against me in said state. Bla bla waive rights to contest extradition etc etc

How do I find out about the terms the court sets on a bond? I thought the bond being PAID to the court was pretty much it ... now that I think more about it, sure, that stands to reason that the court allows you to bond out for $x and sets x an x requirements

You do whatever you want to do but I suggest verifying with both the court and your bond agent to verify going to Kansas will not be a problem.

Hi.. I didn't mean to be arguing with you, just trying to understand everything.

I spoke with them and:

Apparently since I am not on PTR I am alright with the court ... and the bonding company is only out $2000 until the bond discharges come in ... after those arrive it's only $500 and I can pay that and we can get the ring back and I can go places.

So I talk to the clerk of court today and apparently NOW they won't give a discharge of bond because "they're all a part of the same case"

They should NOT be allowed to @()*$@)( me over that way

Something is absolutely NOT right about that

I'm essentially ON BOND FOR NONEXISTENT CHARGES

Now I don't mind answering to this but they should not be allowed to get away with certain things, there should be SOME limit
