What is the name of your state (only U.S. law)? IN, KY

I got an MIP in IN (IC 7.1-5-7-7 Illegal possession of alcohol) but don't live there (in KY). Is it common for a judge to put someone who lives out of state on probation or are they more likely to go for fines, jail/something the person can take care of and then leave again? Does being out of state influence the outcome? And can a judge take an out of state record into consideration?

It's a misdemeanor. The punishments for misdemeanor alcohol related offenses include but are not limited to jail time, alcohol counseling, license suspensions and community service.

You may want to consult an attorney before you go to court.

You don't get a pass just because you broke the law in a state where you do not live. The judge can put you on probation, and then you can apply to have the probation transferred to your state of residence. BTW, there is an Interstate Compact fee for transferring probation. And why wouldn't the judge be able to take your out-of-state record into consideration? If you have a record, you have a record.
