Pictures not taken by Police

What is the name of your state (only U.S. law)? Florida.


Can someone tell me if police do not take Photos from an assault and then one party presents photos several days later do they hold any legal bearing???My wife was assaulted by my mother and today she had some photos emailed to my ex of huge bruises on her arm. The police did not take any pictures.

Sure, they can be presented at trial. The defense can always argue that there is no proof the bruises were inflicted by the defendant, but credibility is a matter for the jury to decide. A judge MIGHT entertain a motion to preclude the pictures if presented by the prosecution and no proper foundation is made, but that's a matter for the court.

Thank you.. Yes I hope credibility is what will help. This person has a warrant fro back CS over 30K and has been arrested several time for DUI and tried commiting suicide!

Bruises normally take time to develop. Everyone in your situation seems to have credibility issues.
