Hi I was recently involved in a warez piracy sting operation by the fbi. I have not been charged yet but a search warrent was issued and they seized many thing involved in the case and not involved in the case. I have a hearing on monday becuase 90 days is up and they have to file for an extension if they want to keep my things. They want to keep my harddrives to gather more evidence. Any advice on what i should say, obiously i dont want them to have anymore time to develope even more on me. I think 90 days to search my drives is plenty, theres not much on them and there asking for another 9 months. Shouldn't be my problem if they are doing it slowly right ? Also any suggestions on things i should/shouldn't do while in court. Can i argue at this court hearing that the warrent should never have been issued becuase they didn't know who i actually was all they knew was it was somebody named korax on a computer. They never knew it was me specificlly. Any help would be greatly appreciated sorry for run on sentences :)

At this point you should get an attorney.

And they knew damn well who you were. They wrote down your IP (which you essentially broadcast when you do anything on the net), then went to your ISP and had the ISP match the IP with a customer account - You.

You need a lawyer. While you could argue that 90 days is enough, there are many plausible excuses for the police to make.

And don't kid yourself, they know who you are.

I relize ip can point to an account but that doesn't proove it was me who was at the computer. The account isn't even registered to my name. 2nd it could be somebody even outside due to wireless connection.

Which is what, no doubt, they did when you came here and admitted guilt. Which says that not only are criminals stupid, but they don't learn.

So what? Once they know it is you they will prove other things to the same finish.

I am a computer forensics student and I would like to thank people like you for giving me a future. My best advice is get an attorney and quick since you are involved with the FBI. Secondly you just admitted guilt and are screwed by that. The FBI is probably logging you online activities as we speak if your using the same account.

I can however tell you that your hardware is in the best forensics labs in the world. Rest assured the FBI has made several copies of your drive for forensics analysis. For the evidence to be valid the hash numbers must be identical accross the board. The FBI did not need 90 days to copy and hash your drive contents but are probably looking to pin other stuff as it develops.
Make no mistake the forensics recovery and analysis procedures are very detailed and cover everything in that drive. You better hope that porno was legal because a fragment can be recovered and reconstructed.


Without a lawyer you are at the mercy of the federal government and that is not good. I know the FBI covered all bases in the acquisition and recovery of their evidence. I would not approach the government with those weak arguments. I know you don't know just how detailed a recovery is and I would worry.
