Question

please help a.s.a.p


Hi
Here is my problem, I got charged with theft [ recieveing stolen property] it is a class D felony. This is the frist time I have ever been in trouble I have a public defender he doesn't tell me much. The DA offered a plea agreement of 275 days probation and said that from 0 to 30 days in jaol and it could be drop down to a mistamener. The public defender has told me even if I take the offer the Judge can still put me in jail. What are the chance of that happening? I have paid for the property even before charges were brought against me. I have worked with the police and have been completely honest through the whole deal. Would it help if I talked to the DA on my own?
Please help me I don't know what to do.

Do not attempt to talk to the DA without your attorney. If the plea agreement includes the possibility of jail time, then the judge has that option. Your alternative to accepting a plea under those terms is to contest the charge and go to trial. You don't state where you are, so I have no idea what the judge might do. I would think it is unlikely that you would get any time in jail for a first theft offense.
