Police misconduct, malicious prosecution


What is the name of your state? Virginia

I allowed a man to rent 2 rooms in my house, one for his 21 y.o. daughter. They were clashing with another man who was renting a different room and had been there for 1 year already.

References to the man and hs daughter, hereafter are The Quirks. Referrences to the other man who was already living here for a year, is as the Doper.

The Quirks left a note on the table that said "payment of rent stops until the Doper moves out. the quirks tried to set up the Doper to be arrested for Assault and battery, so I decided to kick out the Quirks. They said they knew the law and I must follow ordinance proceedures. The Quirks and the magistrates made it very strict.

First I chose the Non-remedial Breach proceedure. the Quirks asserted that I did not serve them properly and that I must start the process all over again. 2 or 3 weeks had already lapsed so I gave another notice for Non- payment of rent so that I wouldnt have to wait 30 days for them to move out willingly.

Meanwhile The Doper is waiting for his alleged Assault and battery court case to come up.

I work for a granite company and spent most of the time out on a business trip, and had to deal with the nonsense when I came back home. The company is in India and my boss comes to this country every few months and we go on the road as travelling salesmen. We came home for the July 4 weekend and went back out on the road again for 10 days after that.

The Quirks tried to allege that I was a terrorist and that they overheard me on my phone, while I was in my bedroom with the door open, that they heard me from the bottom of the steps saying that I was going to blow up the police station and shoot the cops when they come out.

They confronted me with the idea and continued to assert that they were going to put me in jail if I didnt do what they wanted. When they would start arguements I would call the police as a Domestic in progress.

The last time I called police to intervene, the officer said he was getting a warrant on me for 911 abuse and for me to turn myself in, or he would be back in the morning to arrest me. I went to the magistrates and asked if there was a warrant and tried to find out why the cops were treating me that way.

A few days later, the sheriff put the notice on the door for the quirks to appear in court for eviction. On that afternoon One of the Quirks, the father of the daughter, started an arguement, taunting me about calling the police, and said "you cant even call the police because they'll arrest you for 911 abuse, So I will."

I went about minding my own business and after awhile left the house to visit friends in the neighborhood, who were discussing the situation I was in. I came back home and took a nap. The police woke me up and arrested me. The man said I attacked him with a knife and said I was going to kill him, but that I choose when and how I want to die, and that I want to die by a policeman.

While I was in jail, the man looted my house and had pushed his way into the next door neighbors house to live in their basement.

A high paid lawyer got my charges null processed, but there are 2 parts to the Bomb and burn law. Part B says : any person who communicates to another by any means, information knowing the same to be false, as to the existence of any peril of Bombing, burning, destruction or damage to any such place of assembly, building or structure, shall be guilty of a class 5 felony.

I have evidence that I confronted Mr.Quirk while videotaping the occurance hoping he would bring up the subject of the alleged terrorist threats. He asked me if I was going to deny his allegations. I said "yes." His responce was that "he's not giving me the benefit of this videotape and that it is against the law to tape his voice without his permission;and so that I can go away now.

After moving into the next door neighbors house, he showed them weapons and threatened that they would regret it if they went into his space in the basement.

The police will not arrest him. He had said he was a SGT major in the army and fought 5 tours of duty in Viet nam, then was in law enforcement 10 years. While I was out on bail, he tried to return to my house and I would not let him in. I turned on the video cam and went outside to see some friends who were arriving coincidentally. He threatened to put me back in jail for larceny if I didnt let him in and then told my friends, on tape that I had told him to leave because my buddies were coming and they were going to kick his ass. Another lie. So they left and I went in the house, pointed the camera out the window and recorded him telling his daughter that he "has people owing him favors 20 years He's ( I am )going to jail"

What can I do about the police not arresting him and arresting me falsely?
