Police searched my house???


New Jersey

While on vacation our 19 year old house-sitter had a gathering. My next door neighbor called police about a Juvenile drinking party. Police searched the outside of my property, officers entered my house, unannounced and uninvited, through an unlocked back door. They radioed other officers to enter via the front door. They told everyone to leave, including my house-sitter. And told her to dump the booze or go to jail. They then started searching my house from top to bottom. Not trashing the place but still.
My neighbor across the street says that he heard no disturbance and only noticed that something was going on when he was walking his guest to their car. This is when he saw the police going through my bedroom with flashlights.
They did not identify themselves or anything just walked right in.
And who are they to say who can be in my house?
Plain view does not apply, they had to be on my property to see what was going on.

Sounds like they had probable cause. After the neighbor called and made a complaint, police arrived, apparently found the report credible, entered, and did indeed find an underage drinking party in full swing.

If the police had discovered two teens in your bedroom robbing you blind, would you still be upset? Or a teen unconscious on your bed from alcohol poisoning who would have died had they not called an ambulance?

Had either of these things happened, I presume you'd be posting here about the police being negligent in not searching the house.

You are upset about the actions of the police, not your totally irresponsible housesitter who's responsible for all this. Go figure.

Well said beth, but be prepared for the slamming that plifter/bomber/immigrant will be aiming your way. He's a real idiot. If you check back through his many ranting posts, you'll see. IAAL kicked him off as bomber and he came back as immigrant.

Yep, it was plifter/bomber/immigrant who got booted and came back pretending to be me. I didn't notice the missing "l" right away and then I was worried no one else would either.

It took me a few to realize it also. I was reading the post refering to someone as a stupid azz ****** when I thought uh oh Rochelle has lost it, then I noticed the missing l. I it wasn't hard to figure out after that, what an Idiot plifter/bomber/immigrent/rochele is proving his self to be.

In Pennsylvania, courts have ruled that underage drinking does not constitute an exception to the warrant requirement, and therefore the uninvited entry would be illegal.

I'm going to assume that NJ is different.

The police were there to investigate a complaint of a loud party. Arriving at the house, they hear the loud party going on. In order to further their response to the complaint, they entered upon your lawn (how else would they make contact?). As they approach, any sane person would look in the window to see what's going on. They see persons who appear to be underage consuming alcohol. In NJ this may very well be PC top enter without a warrant.

Check with a local attorney.
