This happened on school property. My seventeen year old
son and about a dozen of his friends were standing in
the school parking lot after school. An undercover ATF agent was in the parking lot also. Several kids were smoking cigarettes they claim and they approached the
kids. The only kid ticketed was my son for possession of tobacco by a minor. My son asked why he was being given a ticket, he was not smoking and they said that was his cigarret butt on the ground. There were about 20 butts on the ground next to where he was standing. They said that gave them probable cause to search his vehicle. He told them they needed a search warrent and they told him if he had been parked across the parking lot they could not
have legally searched his car. Anyway when they search-
ed his person and his vehicle they found no cigarettes,
the ashtray was clean, but they ticketed him anyway for
possession of tobacco by a minor. I disagree with this
ticket and would like some advice. This is a $250.00
dollar fine.
