Is it possible to request personal documents that have been searched?

Hi, at first congratulations for this excellent forum!!

Now, the police broke into my house without any Warrant and
started looking for whatever evidence of ... they didn't say.

In any case they took out computers, personal belongings, etc.
And even personal ids from everyone living at home.

I think I have to hire an attorney ASAP to submit a couple of motions

But my question is:
Since I have already gone to the police station requesting at least our ids,
and they haven't been willing to give anything back until the case gets thru.
Is there any procedure (in Court or wherever else) to obtain at least our personal ids?

Yes there is! It's called the DMV. You can get driver licenses, IDS, Cost about 7-15 dollars depending on where you live.

Please take into account that some of us are not citizens and they even took
passports and other kind of personal ids.

You can get passports at the post office

two things here:

I don't think it is that easy to get a duplicate passport and:

maybe the cops are keeping the passport for a reason, especially since some of you are not citizens.

But instead of trying to figure out what might be hapenning,

Do you know about any motion for requesting documents? or

Do we have to wait until any specific point in the process?
Let's say we know about charges, or prelim hearing or any other ...

Well here we go,,,,,there is something that you haven't told us. How do you expect anybody to give you any answers without any info?

I would suggest getting a local attorney involved. Having your ids/passports seized can have definite punitive effects in today's world. If you want the police to return them, having a lawwyer involved should ensure that proper procedures for the requests are followed so that you have a greater liklihood of succeeding.

It could be that the items were seized to check if they were fake. Your lawyer should be able to put pressure on them to get them returned if they are indeed valid.

The OP did not turn it in. It was seized in a "police break in".

I'm sure there is much more that the OP has not told us .

As well, as a previous poster has stated the possibility of them being fake.

The OP doesn't want to give up any info so it's anybodies call from here.

It is faar more common for a judge to order the surrender of one than a police officer to seize one.

The OP fails to state a reason for the police to enter the house, claims there was no warrant and does not give any indication why the police would do such an uncommon thing as to seize ID documents.

With no facts avaialble, the best I can guess is that the documents are evidence of a crime - in terms of forgery or visa stamps tracking travel dates.

However, since we cannot force the OP to provide any relevant facts, the best we can do is refer them to an attorney who will try to get some answers from the OP or the DA.
