pre-warrant hearing???


From Macon, Ga (bibb co.)
My son age 23 lived with a young lady age 18 for approx. 4 months. During which time my son sold his car and she purchased a car for him as a gift for $3,000.00. Although she paid for the car she had the dealership put everything in his name. He has possession of car, title and tag (all in his name). One month after purchase they broke up. Three months later (now) her mother decided to take over as power of attorney for daughter saying she is not capable of managing money and my son took advantage of her and wants car back. A small card was delivered to my sons job only stating the mothers name v/s my sons name and a court date in 2 weeks for a Pre-Warrant Hearing. What is a Pre-Warrant Hearing? Does he have to return this car or pay for the car? Can he be arrested for something?

New Info...


Just found out that the mother is trying to get my son charged with "Theft by deception".
Still need to know if he legally can be made to return car or pay for it. Can he be arrested?

It is up to the District Attorney, not the girl's mother, whether there is enough evidence to bring charges. From what you say it sounds like there was no theft. Your son does not have to show up in response to a card, but only to a subpoena. If the car was a gift, he has no legal obligation to return it. Moral obligation is another story.
