probation officer's search


What is the name of your state? New York

Does my 15 year old's probation officer have the right to come into my home, bringing another probation officer with him, and search/look around my house without myself or my husband home?

Probationary searches are a very common element of the probation process. Read your copy of the terms for release you signed when your son was granted parole.

This Information is from my own personal expereriece, I have custody of my 16 year old nephew who as of today has succesfully completed one year of probation and the first time we meet with his probation officer and she went over all the rules he was to follow ect. we also sighned several papers that included a warrentless search of our home that could be acted upon without any notice and did not state that an adult had to be home at the time. and twice over the past year this was carried out and both times nether myself nor my husband was home but our kids were and they told us that the p/o came in looked around and was satisfied. it's just part of the price we pay when one of our own decides to make a bad choice.
